These Terms of Service ("Terms") constitute a legally binding agreement between you ("you") and sftp.ing ("we", "us", "our") regarding your use of the https://sftp.ing website and related services (collectively, the "Service"). sftp.ing provides a private, secure file-sharing platform where publishers relay files to viewers via WebSocket connections. We do not store file contents on our servers; files are only available when the publisher is connected. Publishers retain full control over file availability.
The Service, including its design, code, and marks, is our proprietary property, protected by applicable laws. You are granted a limited, non-commercial license to use the Service for file sharing. You may only share files you own or have rights to distribute, cleared of intellectual property restrictions.
By using the Service, you warrant that: (1) all information provided is accurate and current; (2) you have legal capacity to agree to these Terms; (3) you are 18+; (4) you will not use automated means (e.g., bots) to access the Service; (5) your use complies with all laws.
Registration may be required. You are responsible for keeping your credentials confidential. We may reject or reclaim usernames deemed inappropriate.
You may not: (1) distribute viruses, malware, or illegal material; (2) abuse WebSocket connections or send malformed data; (3) bypass security features; (4) harass or harm others; (5) use the Service for unauthorized commercial purposes; (6) violate any laws.
Files you share ("Contributions") are private and only accessible via links while you're connected. You represent that Contributions: (1) do not infringe third-party rights; (2) are legally yours to share; (3) are not illegal, obscene, or harmful. We do not store or scan Contributions.
You grant us a limited, non-exclusive license to relay your Contributions to viewers via the Service while you're connected. We do not retain, reproduce, or distribute Contributions beyond this purpose. You retain ownership of your files.
We prioritize privacy and security. See our Privacy Policy for details. Files are encrypted in transit, but you are responsible for link security. We are not liable for breaches due to sharing links with untrusted parties.
We may block accounts or IP addresses at our discretion, without notice, for any reason, including violations of these Terms.
Files are not stored on our servers; they are relayed from publisher to viewer. Links are only active when both parties are online and connected via sftp.ing. Publishers must notify viewers of links externally; we do not share links automatically.
The Service is provided "as is." We disclaim all warranties, including merchantability or fitness for purpose. We are not liable for content shared, security breaches from link sharing, or service interruptions.
We are not liable for any damages (direct, indirect, or consequential) from your use of the Service, including content shared, as we do not store or scan files.
You agree to defend, indemnify, and hold us harmless - including our affiliates, officers, agents, employees, and any related parties - from and against any and all losses, damages, liabilities, claims, demands, or legal actions, including reasonable attorneys' fees and expenses, that any third party might bring against us as a result of: (1) the files you choose to share through the Service (referred to as "Contributions"); (2) how you use or misuse the Service, such as sharing links irresponsibly or attempting to overload our systems; (3) any violation of these Terms of Service or our Privacy Policy, such as sharing content you don't have rights to; (4) any breach of the promises you make in these Terms (e.g., that your information is accurate or your Contributions are legal); (5) any infringement of someone else's rights - like copyrights, trademarks, or privacy - caused by the files you relay through us; or (6) any harmful actions toward another user or third party that your use of the Service enables, such as giving a file link to an untrusted person who then misuses it.
What this means for you: As a user, this clause places full responsibility on you for what you share and how you use `sftp.ing`. Since we don't store your files on our servers - we only act as a relay between you (the publisher) and the viewer via WebSocket connections - we have no way to control, monitor, or verify the content of your Contributions. If your actions lead to trouble - like a lawsuit from someone claiming your file broke the law, or a complaint because you shared a link with the wrong person - you're the one who has to handle it. This includes paying any damages, fines, or legal costs we incur defending ourselves.
Why we're not accountable: `sftp.ing` cannot and will not be held accountable for anything related to your Contributions or your use of the Service. Because we don't keep your files, scan them, or decide who gets access (you do that by sharing links), we're just a conduit - a middleman passing data from you to your viewers. This means we can't be blamed for what's in your files (e.g., if they're illegal, harmful, or stolen) or what happens after you share a link. Our role ends at providing the technology to connect you and your viewers; everything else - content, security, legality - is entirely up to you. This protection is absolute: under no circumstances can we be held liable for your actions, as long as we're operating within the scope of these Terms.
We maintain minimal data (e.g., connection status) to operate the Service. You are responsible for your files; we are not liable for data loss since files are not stored.
You consent to electronic communications, including agreements and notices, which satisfy legal requirements for writing.
You must accept these Terms and the Privacy Policy via a prompt every 30 days to use the Service. Acceptance is stored locally for 30 days.
These Terms of Service, along with our Privacy Policy and any other operating rules we post on the Service, represent the complete and final agreement between you and us regarding your use of `sftp.ing`. There are no side deals or unwritten understandings beyond what's here. We reserve the right to assign or transfer any of our rights or obligations under these Terms to another party (e.g., if we sell or partner with another company), but you cannot assign your rights or obligations to anyone else without our explicit written permission. If any part of these Terms is found to be unlawful, void, or unenforceable by a court or law, that part will be cut out, but the rest of the Terms will still apply fully. Your use of the Service does not create any joint venture, partnership, employment, or agency relationship between you and us - you're just a user, and we're just providing the platform.
Changes to Terms or Privacy Policy: We can modify these Terms of Service or our Privacy Policy at any time, for any reason, at our sole discretion. When we do, we'll update the "Last updated" date at the top of this page (or the Privacy Policy), and that's your notice. We don't have to send you an email or pop-up - we might, but we're not required to. By continuing to use `sftp.ing` after such changes, you're agreeing to the new version, whether you've read it or not. It's on you to check back periodically to stay informed. This flexibility lets us adapt to new laws, features, or business needs without being locked into old rules.
